Last updated: 01/10/2026

These Terms & Conditions apply to products and services supplied by [LEGAL BUSINESS NAME] trading as Blue Square Audio (“Blue Square Audio”, “we”, “us” or “our”) through the Blue Square Audio website and any other sales channel operated by us.

By placing an order with Blue Square Audio, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law (ACL) or any other applicable law.

1. About Blue Square Audio
Blue Square Audio designs and supplies professional and enthusiast audio connectivity equipment, including audio interfaces, stage boxes, mixer interfaces, S/FTP cables and associated accessories.

Our products are designed primarily for use in professional, live, studio, rehearsal, installation and enthusiast audio environments.

Product specifications, configurations and availability may change from time to time as our products are developed and improved.

2. Products and Configurations
Many Blue Square Audio products are configurable.

Depending on the product, configurations may include:
XLR male connections;
XLR female connections;
TRS connections;
TS instrument inputs;
passive transformer-balanced inputs;
audio sends and returns;
S/FTP or EtherCON-compatible connections; and
other options described on the relevant product page.

The configuration selected by the customer at the time of purchase forms part of the order.

Customers should carefully check their selected configuration before completing their purchase.

Where a customer requests a non-standard or custom configuration, Blue Square Audio may confirm the configuration with the customer before commencing manufacture.

3. Product Development and Specifications
Blue Square Audio products may be subject to ongoing development and improvement.

We may make reasonable changes to:
component selection;
PCB design;
enclosure design;
labelling;
connector selection;
internal construction;
manufacturing processes;
dimensions; and
cosmetic appearance,
provided that the resulting product continues to meet the specifications and representations applicable to the customer's order.

Where a change materially affects the product purchased, we will notify the customer where reasonably practicable.

Photographs shown on the website are representative only. Minor variations in colour, finish, engraving, labelling, hardware and construction may occur between photographs and supplied products.

4. Prices
All prices displayed on the Blue Square Audio website are in Australian dollars unless otherwise stated.

Prices may be changed without notice. A price change will not affect an order that has already been accepted by Blue Square Audio.

Where applicable, GST will be charged in accordance with Australian law.

The total price payable will be displayed before the customer completes their purchase.

5. Orders
An order submitted through the website constitutes an offer by the customer to purchase the selected products.

An order is accepted when Blue Square Audio:
confirms the order; or
begins manufacture or fulfilment of the order,
whichever occurs first.

We reserve the right to decline or cancel an order where:
a product has been incorrectly listed or priced;
a product is unavailable;
a requested configuration cannot reasonably be manufactured;
there is an obvious error in the order;
we reasonably suspect fraudulent activity; or
we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.

6. Made-to-Order Products
Many Blue Square Audio products are manufactured or configured specifically in response to an order.

Unless otherwise stated on the relevant product page, made-to-order products are generally dispatched within approximately 5 business days of an order being placed.

For orders involving multiple units, custom configurations or unusual component requirements, the manufacturing period may be longer.

Where a significant delay is expected, we will communicate this to the customer where reasonably practicable.

7. Custom and Configured Products
Where a customer requests a custom configuration, the customer is responsible for providing accurate requirements.

This may include:
number of inputs and outputs;
connector type;
send/return configuration;
cable requirements;
labelling requirements; and
other configuration details.

Blue Square Audio may request confirmation of the configuration before commencing manufacture.

Once manufacture of a custom product has commenced, cancellation or alteration may not be possible.

This does not affect any rights the customer has under the Australian Consumer Law.

8. Shipping and Delivery
Blue Square Audio ships products to addresses accepted by our available shipping services.

Shipping times are estimates only and may be affected by:
manufacturing time;
carrier delays;
weekends and public holidays;
remote delivery locations;
weather;
customs or border processes; and
events outside our reasonable control.

Once a product has been handed to the nominated carrier, Blue Square Audio is not responsible for delays caused by that carrier, except where liability cannot lawfully be excluded.

If an item is lost or damaged during delivery, customers should contact us as soon as reasonably practicable so that we can investigate and assist with the carrier claim where applicable.

9. Inspection on Delivery
Customers should inspect products as soon as reasonably practicable after delivery.

If a product appears to have been damaged during delivery, please contact Blue Square Audio with:
the order number;
photographs of the product;
photographs of the packaging; and
a description of the damage.

This helps us investigate and resolve the issue as quickly as possible.

Nothing in this section limits a customer's rights under the Australian Consumer Law.

10. Intended Use
Blue Square Audio products are designed as passive audio connectivity equipment for professional, live, studio, rehearsal, installation and enthusiast audio applications.

Products should be used:
with compatible audio equipment;
within the published signal and electrical specifications;
with compatible cables and connectors; and
in accordance with any product-specific instructions.

Products should not be:
connected directly to mains voltage;
operated outside their published specifications; or
used for purposes for which the particular product was not designed.

Customers are responsible for ensuring that connected equipment is compatible with the relevant Blue Square Audio product.

11. Product Safety and Compliance
Blue Square Audio products are designed as passive audio connectivity equipment and do not connect directly to mains power.

Blue Square Audio takes reasonable steps to ensure products are manufactured consistently with their intended design and use.

Customers should use products only for their intended audio application and within the published specifications.

Customers should not modify products in a manner that could affect their electrical characteristics, operation or safety.

Where a particular regulatory requirement applies to a Blue Square Audio product, Blue Square Audio will meet the applicable requirements before supplying the relevant product.

Blue Square Audio will not represent that a product has been independently certified, tested or approved by a particular regulatory authority or laboratory unless that certification, testing or approval has actually been obtained.

12. Equipment Compatibility
Blue Square Audio products are designed to interface with audio equipment using the connection types and signal levels specified for the particular product.

Customers are responsible for ensuring that connected equipment is appropriate for the relevant input or output.

Particular care should be taken to ensure that equipment is connected to the correct type of input or output and that signal levels remain within the published specifications.

Blue Square Audio products should not be connected to speaker-level, amplifier outputs or other signals unless the particular product is specifically designed for that application.

13. Testing and Quality Control
Blue Square Audio products are subject to manufacturing and functional checks appropriate to the product.

These checks may include:
visual inspection;
continuity testing;
connector testing;
signal-path testing;
electrical testing;
functional audio testing; and
inspection of workmanship.

Testing performed by Blue Square Audio does not necessarily constitute independent certification against every Australian or international technical standard.

Where independent certification or testing has been performed, the relevant certification or testing will be identified separately.

14. Warranty
Unless otherwise stated for a particular product, Blue Square Audio provides a [12-month] manufacturer's warranty against defects in materials and workmanship from the date of purchase.

The warranty applies in addition to, and does not replace, the customer's rights under the Australian Consumer Law.

The voluntary warranty does not ordinarily cover damage resulting from:
accidental damage;
misuse;
operation outside published specifications;
unauthorised modification;
incorrect installation;
physical abuse;
liquid damage;
use with incompatible equipment;
incorrect electrical connection;
normal cosmetic wear; or
damage caused by circumstances outside the reasonable control of Blue Square Audio.

These exclusions do not apply to the extent that the Australian Consumer Law provides the customer with rights that cannot lawfully be excluded.

15. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These rights apply independently of any voluntary warranty offered by Blue Square Audio.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee or other right that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

16. Warranty and Fault Claims
To make a warranty or product fault claim, customers should contact Blue Square Audio using the contact details provided on our website.

We may request:
order details;
proof of purchase;
photographs or video of the issue;
information about how the product was connected or used; and
other information reasonably necessary to diagnose the issue.

Where appropriate, Blue Square Audio may ask the customer to return the product for inspection.

If a product is found to have a manufacturing defect covered by our voluntary warranty, Blue Square Audio may, depending on the circumstances:
repair the product;
replace the product;
refund the purchase price; or
provide another remedy required by law.

17. Product Modifications and Repairs
Customers should not open, modify, repair or alter a product where doing so could affect its operation or safety, unless authorised by Blue Square Audio.

Unauthorised modifications may affect the operation, performance or compliance of a product.

Where a modification has caused or contributed to a fault, damage or unsafe condition, that may affect the customer's rights under any voluntary warranty.

Nothing in this section excludes any rights that cannot legally be excluded under the Australian Consumer Law.

18. Returns and Change of Mind
For products that are not faulty and where the customer simply changes their mind, Blue Square Audio may accept a return at its discretion.

Because many Blue Square Audio products are made to order or configured specifically for the customer, change-of-mind returns may not be available once manufacture has commenced.

Where a change-of-mind return is accepted:
the customer may be responsible for return shipping;
the product must generally be returned in its original condition; and
reasonable costs associated with restoring a customised product may be deducted where legally permitted.

This policy does not affect any statutory right to return, repair, replacement or refund.

19. Cancelling an Order
Customers may request cancellation of an order by contacting Blue Square Audio as soon as possible.

For standard stocked products, cancellation may be possible before dispatch.

For made-to-order or customised products, cancellation may not be possible once manufacturing has commenced.

Where cancellation is permitted, any refund will be processed using the original payment method where reasonably practicable.

Nothing in this section limits rights arising from a failure to comply with the Australian Consumer Law.

20. Limitation of Liability
To the maximum extent permitted by law, Blue Square Audio excludes liability for indirect, incidental or consequential loss arising from the use of our products or website.

This may include, where legally permitted:
loss of income;
loss of business;
loss of anticipated savings;
loss of opportunity;
loss of data; or
interruption to business operations.

Nothing in these Terms & Conditions excludes, restricts or modifies any liability or remedy that cannot lawfully be excluded, restricted or modified under applicable law.

In particular, nothing in these Terms & Conditions is intended to exclude or limit the consumer guarantees or other protections provided by the Australian Consumer Law.

21. Third-Party Equipment
Blue Square Audio products are designed to interface with third-party audio equipment.

Blue Square Audio is not responsible for defects, faults or damage originating from third-party equipment.

Where a product has been damaged as a result of a fault in connected equipment, Blue Square Audio may inspect the product to determine the cause of the failure.

This does not affect rights available to the customer under applicable consumer law.

22. Intellectual Property
All intellectual property appearing on the Blue Square Audio website, including:

product descriptions;
PCB designs;

We take reasonable care to ensure information on our website is accurate and current.

However, occasional errors may occur, including errors relating to:
pricing;
specifications;
availability;
dimensions;
photographs;

product configurations.

Where an obvious error is identified, we reserve the right to correct it.

Nothing in this section permits Blue Square Audio to avoid an obligation arising from a representation that is legally binding or from a consumer guarantee.

Our website may contain links to third-party websites.

These links are provided for convenience only.

Blue Square Audio does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

Blue Square Audio will collect, use and store personal information in accordance with our Privacy Policy.

The Privacy Policy forms part of these Terms & Conditions where applicable.

26. Events Outside Our Control

transport disruption;
supplier shortages;
component shortages;
industrial disputes;
government action;

civil unrest;
cyber incidents; or
other events beyond our reasonable control.

Where reasonably practicable, we will notify customers of significant delays arising from such circumstances.

27. Changes to These Terms & Conditions
Blue Square Audio may update these Terms & Conditions from time to time.

The version applying to an order will generally be the version in effect when the order is accepted, unless otherwise required by law.

28. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the minimum extent necessary.

The remaining provisions will continue to operate.

29. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.

The parties submit to the courts and tribunals of New South Wales and applicable federal courts of Australia.

This clause does not prevent a consumer from exercising rights or remedies available under applicable consumer protection legislation.

Terms & Conditions - the basics

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).

T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.

To learn more about this, check out our article “Creating a Terms and Conditions Policy”.
